Property and conveyancing claims are the most numerous and expensive for 2016/17.

One worrying trend is that the number of large conveyancing claims exceeding $1million have increased by 20 per cent compared to 2015/16.

This is one reason LPLC focused on conveyancing claims at the 2017 Risk Management Intensive in a session titled ‘Conveyancing done better’.

This session contained details about some recent claims as well as a number of exercises which highlighted risk management issues in conveyancing matters.

It may surprise some practitioners that within property and conveyancing, tax issues including CGT, duty, GST and land tax, were the highest number of claims for 2016/17. Inadequate advice to purchasers was the area that received the second highest number of claims followed by defective disclosure, usually in section 32 statements.
