In this instalment of the Conveyancing Series Phil Nolan, Risk Manager with LPLC, provide details of caveat claims and considers various legislative provisions and cases about caveats, and provide tips on avoiding caveat claims. Ethical issues are considered including withdrawing a caveat without instructions and terminating the retainer where a caveator will not take a practitioner’s advice.
