Join guest presenter Lucy Dawson, Barrister, as she explores two areas of litigation practice: using generally endorsed writs to protect a client’s position, and identifying and diarising important dates to ensure key deadlines are not missed.
The recent decision in Crowe v Lo & Anor [2026] VCC 1157 highlights the risks of commencing protective proceedings before the relevant cause of action and statutory framework have been properly identified.
This session will examine the lessons from that decision, including the importance of early investigation, ensuring there is a sound basis for commencing proceedings, and providing clients with clear written advice about prospects of success and potential costs.
Lucy will also discuss practical processes and risk-management strategies to help practitioners identify and manage risk at the outset of litigation and at key interlocutory stages.
