Solicitors should be aware of recent changes to practice requirements in the Supreme Court and County Courts of Victoria, as well as updates to the contract of sale of land, lease of real estate, and changes to prescribed forms for enduring powers of attorney.

There have been recent changes that will affect the day-to-day practice of many solicitors. Important changes to court procedures in both the Supreme Court of Victoria and the County Court of Victoria took effect in September 2025. In addition, there are new prescribed forms for enduring powers of attorney (and other associated powers) and there have been amendments made to the Real Estate Institute of Victoria (REIV) / Law Institute of Victoria (LIV) Contract of Sale of Land (‘LIV Contract of Sale of Land’), and the LIV Lease of Real Estate (Commercial Property) (‘LIV Lease of Real Estate’).

This article summarises these key changes and provides links to further information and the new forms.

The Powers of Attorney Regulations 2025 (Vic) commenced on 10 August 2025, replacing the previous regulations. These regulations include new prescribed forms for enduring powers of attorney, supportive attorneys, and associated documents.

Solicitors undertaking this work should update their precedents and ensure they are using the new prescribed forms. These forms, made under the Powers of Attorney Act 2014 (Vic) are now contained in Schedule 1 of the Powers of Attorney Regulations 2025 (Vic) (PDF).

The Supreme Court (General Civil Procedure) Rules 2025 commenced on 8 September 2025 and replace the Supreme Court (General Civil Procedure) Rules 2015. The new rules are available on the Supreme Court of Victoria website (PDF).

The County Court Commercial Division Omnibus Practice Note PNCO 1-2025 (‘Practice Note’), and the Commercial Division Standard Orders Booklet 2025 (‘Standard Orders Booklet’) both commenced on 1 September 2025.

The LIV Contract of Sale of Land has been updated. The amendments are contained in the September 2025 edition.
